Holt Sunday Market.

Trader Terms & Conditions 2027.

Effective for all 2027 markets

These Trader Terms & Conditions apply to all traders accepted to participate in Holt Sunday Market.

Holt Sunday Market is organised by Holt Markets & Events Limited.

By accepting a place, paying a membership or market fee, or attending a market, you agree to these Terms & Conditions.

1. A Curated Market

Holt Sunday Market is a curated market — not simply a collection of available stalls.

Applications are considered according to the quality, originality, presentation and suitability of the business and its products, together with the overall balance of each market.

Submitting an application or Expression of Interest does not guarantee acceptance.

The decision as to which traders are invited to participate rests with Holt Sunday Market.

2. Membership

Traders accepted for 2027 will normally be offered one of the following:

GLD Membership
Commitment to all 10 Holt Sunday Markets.

SLVR Membership
Commitment to 5 Holt Sunday Markets.

Membership relates to the trader and business accepted by Holt Sunday Market and cannot be transferred to another person or business.

3. Market Dates

GLD Members are expected to attend all ten markets for which they have been booked.

SLVR Members commit to five markets.

SLVR Members cannot select their own five dates.

Dates are allocated by Holt Sunday Market to maintain the appropriate balance and curation of traders across the season and to avoid excessive duplication.

Requests for particular dates may be considered but cannot be guaranteed.

4. Fees

Membership fees and market-day fees will be confirmed when a trader is offered membership.

The Membership Fee contributes towards the costs of organising and administering the market throughout the season and is separate from the individual Market Day Fees.

Once membership has been accepted and confirmed, the Membership Fee is non-refundable, except where Holt Sunday Market decides otherwise.

Market Day Fees must be paid according to the payment schedule shown on the trader's invoice or account.

Where instalments are offered, all instalments remain payable in accordance with the agreed schedule.

Failure to make a payment when due may result in future bookings being suspended or cancelled.

5. Trader Cancellations and Non-Attendance

Market places are allocated and curated well in advance.

If a trader cancels, withdraws or fails to attend a booked market, the relevant Market Day Fee remains payable and will not normally be refunded or credited.

Traders must notify Holt Sunday Market as soon as possible if an exceptional circumstance prevents attendance.

Repeated cancellations or non-attendance may affect continued membership and future applications.

6. Cancellation by Holt Sunday Market

Holt Sunday Market is an outdoor event and may be affected by severe weather, public safety concerns, emergency circumstances, local authority requirements, road restrictions, security incidents or other matters outside our reasonable control.

Holt Sunday Market reserves the right to cancel, postpone, relocate, shorten or alter a market where reasonably necessary.

Where Holt Sunday Market cancels an entire market, we will advise traders of the arrangements relating to the relevant Market Day Fee.

The annual Membership Fee will not normally be refundable because it contributes towards administration, marketing, insurance and other season-long costs already incurred.

7. Products You May Sell

Acceptance is based upon the products, photographs and information included in your application.

You may only sell the type and range of products approved by Holt Sunday Market.

You must obtain permission before making a significant change to your product range.

We may ask a trader to remove products which:

  • were not included in or are materially different from the accepted application;

  • create unnecessary duplication;

  • are considered unsuitable for the market;

  • do not meet appropriate quality or presentation standards; or

  • may breach legal, licensing or safety requirements.

A pitch may not be shared with another business without prior written approval.

8. Pitch Allocation

All pitch positions are allocated by Holt Sunday Market.

Acceptance does not create an entitlement to a particular pitch, street, zone or position.

Pitch locations may change between markets.

Operational requirements, access, safety, market curation, neighbouring businesses and local authority requirements may all affect pitch allocation.

Limited premium or fixed-location pitches may carry an additional fee.

The organiser's pitch allocation is final.

9. Arrival and Set-Up

Unless otherwise advised:

Trader set-up is between 7.00am and 9.00am.

On arrival, traders must report to a Market Marshal before attempting to unload or set up.

The procedure is:

Unload first → park your vehicle → return to erect and prepare your stall.

Vehicles must not remain within the market while stalls are being erected unless specifically authorised.

No unauthorised vehicle movement is permitted within the market area between 9.00am and 3.15pm.

Any trader who does not follow the vehicle and unloading procedure may be required to park outside the market area and carry their equipment and stock to their pitch.

10. Trading and Take-Down

Traders must be ready to trade by the published market opening time.

Stalls must remain properly stocked, presented and attended throughout the market.

Traders must not begin dismantling their stall before the official closing time unless instructed by the Market Manager or a Marshal.

At the end of the market:

Pack down your stall → collect your vehicle when authorised → load and leave.

Vehicle access will only be permitted when the Market Team considers it safe to do so.

11. Gazebos, Trailers and Equipment

All equipment brought to the market must be suitable, safe and appropriate for outdoor public trading.

Gazebos must be professionally presented and adequately weighted on every market day, regardless of the weather forecast.

Traders are responsible for ensuring that their gazebo, trailer, display, furniture, signs and other equipment do not present a danger to themselves, neighbouring traders or members of the public.

Trailers, vehicles or structures may only be used where they have been approved in advance.

Generators may not be used without prior approval.

12. Insurance

Every trader must maintain appropriate and valid Public Liability Insurance for all market dates.

Evidence must be supplied when requested and must remain valid throughout the period in which the trader is participating.

Where relevant, traders are also responsible for maintaining appropriate product liability, employer's liability and other insurance required for their business.

Failure to provide valid insurance may result in the trader being prevented from trading without refund.

13. Licences and Legal Compliance

Traders are responsible for complying with all legislation, licences, registrations, permissions and regulatory requirements applicable to their business and products.

This includes complying with requirements imposed by North Norfolk District Council and any conditions attached to the Street Trading Consent or other permissions under which Holt Sunday Market operates.

Traders must provide information or documentation reasonably requested by Holt Sunday Market for licensing, insurance or regulatory purposes.

14. Food & Drink Traders

Food and drink businesses must meet all applicable food-safety and registration requirements.

Where required by Holt Sunday Market, food businesses must hold a current Food Hygiene Rating of 5.

Food traders are responsible for:

  • food hygiene;

  • allergen information;

  • safe food storage and temperature control;

  • labelling;

  • sampling;

  • cleaning;

  • waste disposal; and

  • all other legal requirements relating to their products.

The sale of alcohol is only permitted where specifically agreed in advance and where all necessary licensing requirements have been satisfied.

15. Electrical, Gas and Cooking Equipment

All electrical, gas, cooking and heating equipment must be safe, properly maintained and suitable for commercial use.

Traders must provide appropriate current safety documentation when requested.

Open flames, cooking equipment or other higher-risk equipment must not be introduced without prior approval.

Holt Sunday Market may require equipment to be disconnected or removed where there is a reasonable safety concern.

16. Safety and Emergency Procedures

Traders must follow all reasonable instructions given by the Market Manager, Marshals, security personnel, emergency services, North Norfolk District Council or other relevant authorities.

Emergency routes, vehicle access routes, entrances and pedestrian routes must remain unobstructed.

Traders must familiarise themselves with any safety, evacuation, emergency or security information issued before a market.

Where applicable, traders must cooperate with procedures introduced by Holt Sunday Market to meet its obligations under the Terrorism (Protection of Premises) Act 2025 — commonly known as Martyn's Law — and related public-safety requirements.

17. Weather

Holt Sunday Market is an outdoor market and normal British weather conditions should be expected.

Rain, cold, heat or ordinary wind conditions do not automatically constitute grounds for cancellation or refund.

Each trader remains responsible for providing suitable equipment, clothing, protection for stock and adequate gazebo weighting.

Where conditions create a genuine safety concern, Holt Sunday Market may alter trading arrangements or cancel the market.

18. Waste and Cleanliness

Traders must keep their pitch clean and tidy throughout the day.

All stock, packaging, food waste, oil, liquid waste, cardboard and other trade waste must be removed at the end of the market unless specifically instructed otherwise.

Nothing may be poured into drains or left behind.

The pitch must be left in the condition in which it was found.

19. Behaviour

Holt Sunday Market is intended to provide a welcoming and professional environment for visitors, traders, residents and businesses.

Traders and their staff must behave respectfully towards:

  • members of the public;

  • neighbouring traders;

  • local businesses;

  • Market Marshals and staff;

  • contractors;

  • landowners; and

  • representatives of local authorities.

Abusive, threatening, discriminatory, aggressive or persistently unreasonable behaviour will not be accepted.

Serious misconduct may result in immediate removal from the market and cancellation of future bookings.

20. Responsibility for Sales

Each trader operates as an independent business and is solely responsible for their own products and transactions.

Traders are responsible for ensuring that products are safe, accurately described, appropriately labelled and legally permitted for sale.

Each trader is responsible for dealing appropriately with their own customer complaints, returns, refunds and other consumer matters.

Holt Markets & Events Limited is not a party to transactions between individual traders and their customers.

21. Staffing

The accepted trader or a suitable representative must be present throughout the market.

Any staff or representatives working on a trader's stall are the trader's responsibility and must comply with these Terms & Conditions.

The pitch must never be left unattended in a way that creates a safety or security risk.

22. Photography and Promotion

Holt Sunday Market may photograph or film the market for editorial, promotional, website and social-media purposes.

By supplying photographs, logos, business descriptions or other promotional material to Holt Sunday Market, the trader confirms that they have the right to provide that material and grants Holt Sunday Market permission to use it to promote the trader and the market.

23. Suspension or Termination

Holt Sunday Market may suspend or terminate a trader's membership or future bookings where there is:

  • non-payment or failed collection of fees.
    All fees must be paid through an active GoCardless Direct Debit mandate. In the event that a scheduled payment is missed, declined or cannot be collected for any reason, an administration fee of £12 will be charged for each unsuccessful collection. This fee will be payable in addition to the outstanding amount;

  • failure to maintain required insurance;

  • misleading information in an application;

  • repeated non-attendance;

  • serious or repeated breach of these Terms;

  • unsafe trading;

  • serious misconduct;

  • sale of unapproved or unlawful products; or

  • failure to comply with licensing or regulatory requirements.

In serious circumstances a trader may be required to cease trading and leave the market immediately.

Fees already paid will not normally be refunded where participation is terminated because of the trader's breach.

24. No Guarantee of Sales

Holt Sunday Market promotes and operates the market but cannot guarantee visitor numbers, weather conditions, individual trader sales or financial performance.

Participation is undertaken at the trader's own commercial risk.

25. Liability for Property

Traders remain responsible for their own stock, equipment, vehicles, money and personal property.

Holt Markets & Events Limited cannot accept responsibility for theft, loss or damage except where liability cannot lawfully be excluded.

26. Changes to These Terms

Market operations, licensing requirements and legislation may change.

Holt Sunday Market may amend these Terms & Conditions where reasonably necessary.

Traders will be notified of any material changes affecting their participation.

27. Acceptance

By accepting membership, paying an invoice or attending Holt Sunday Market, the trader confirms that they:

  • have read these Terms & Conditions;

  • understand them;

  • agree to comply with them; and

  • accept responsibility for ensuring that their staff and representatives also comply.

28. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.
